FEDERAL JUDGE DISMISSES PRIVACY SUITS AGAINST DOUBLECLICK

New York, 3/30/01 - DoubleClick Inc. (Nasdaq: DCLK), theleading digital marketing solutions company, today announced that United States District Judge Naomi Reice Buchwald, dismissed all federal privacy suits against DoubleClick.

“We are delighted with the Court’s decision,” stated Kevin Ryan, CEO, DoubleClick. “DoubleClick has always maintained that its business practices are in compliance with the law and this decision confirms that.”

Class action lawyers had alleged that DoubleClick’s online advertising delivery practices violated three federal statutes: the Electronic Privacy Act, the Wiretap Act, and the Computer Fraud and Abuse Act.

In her 71-page opinion, Judge Buchwald concluded that “Plaintiffs’ Amended Complaint fails to plead violations of any of the three federal statutes under which they bring suit.” The Court found an absence of evidence in legislative and judicial history of any of these Acts to suggest that Congress intended to prohibit the type of business practices engaged by DoubleClick.

“This groundbreaking decision marks the first time a court has interpreted these statutes in the context of Internet advertising,” said Elizabeth Wang, Vice President and General Counsel DoubleClick.

In considering the motion, Judge Buchwald was required to accept as true all of plaintiffs’ allegations and still arrived at the conclusion that DoubleClick could not have violated the federal statutes. The Court also dismissed all of the state claims alleged against DoubleClick, refusing to exercise jurisdiction over those claims.
